Waybig Blog respects the intellectual property rights of others and expects its users to do the same. In accordance with the Digital Millennium Copyright Act of 1998 (DMCA), the text of which may be found on the U.S. Copyright Office website at https://www.copyright.gov/legislation/dmca.pdf, we will respond expeditiously to claims of copyright infringement committed using the Waybig Blog service and website.

1. Notice of Copyright Infringement

If you are a copyright owner, authorized to act on behalf of one, or authorized to act under any exclusive right under copyright, please report alleged copyright infringements taking place on or through the site by completing a Notice of Alleged Infringement and delivering it to our designated email.

Upon receipt of Notice as described below, Waybig Blog will take whatever action, in its sole discretion, it deems appropriate, including removal of the challenged content from the site.

2. Requirements for Filing a DMCA Notice

To file a copyright infringement notification with Waybig Blog, you will need to send a written communication that includes the following details:

  1. Identification of the copyrighted work: A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed, along with a description of the copyrighted work claimed to have been infringed.
  2. Identification of the infringing material: Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material (e.g., specific URLs of the pages where the material resides).
  3. Contact Information: Information reasonably sufficient to permit Waybig Blog to contact the complaining party, such as an address, telephone number, and, if available, an email address at which the complaining party may be contacted.
  4. Good Faith Statement: A statement that the complaining party has a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. Accuracy Statement: A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

3. How to Submit Your DMCA Notice

4. Counter-Notification Procedure

If you believe that your content was removed (or to which access was disabled) by mistake or misidentification, you may send us a counter-notification containing the following details:

  1. Your physical or electronic signature.
  2. Identification of the material that has been removed or to which access has been disabled and the location at which the material appeared before it was removed or access to it was disabled.
  3. A statement under penalty of perjury that you have a good faith belief that the material was removed or disabled as a result of mistake or misidentification of the material to be removed or disabled.
  4. Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the Federal District Court for the judicial district in which the address is located.

5. Repeat Infringer Policy

In accordance with the DMCA and other applicable law, Waybig Blog has adopted a policy of terminating or blocking, in appropriate circumstances and at our sole discretion, users or contributors who are deemed to be repeat infringers.
